[COLUMN] Court ruling a victory for liberty
The U.S. Supreme Court on Thursday scored a victory for liberty when it correctly struck down a 32-year-old Washington, D.C., law banning handguns and ruling for the first time that the Second Amendment is a personal right and not a right of the states to maintain militias.
In other words, the Second Amendment to the U.S. Constitution means exactly what it says: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."
This seems obvious to me. After all, why would Congress and the states create a Bill of Rights for the people and include in it a right for the states to form militias?
That would make no sense.
The Bill of Rights was meant to recognize some of the rights of the people, not of the government. The amendment even specifically states "the right of the people to keep and bear Arms, shall not be infringed." Seems pretty specific. Additionally, the phrase "right of the people" is used several other times in the Bill of Rights and in the unamended Constitution.

It is a well-reasoned opinion. Justice Antonin Scalia, whose opinions are almost always well-argued, outdid himself with this one.

The U.S. Supreme Court today handed a victory for liberty when it correctly struck down a 32-year-old Washington, D.C., law banning handguns and ruling for the first time that the Second Amendment is a personal right and not a right of the states to maintain militias.
"Undoubtedly some think that the Second Amendment is outmoded in a society where our standing army is the pride of our nation, where well-trained police forces provide personal security and where gun violence is a serious problem," Justice Antonin Scalia wrote. "That is perhaps debatable, but what is not debatable is that it is not the role of this court to pronounce the Second Amendment extinct."
It is the most sweeping Second Amendment ruling by the court in U.S. history. Scalia was joined by Chief Justice John G. Roberts Jr. and Justices Samuel A. Alito Jr. and Clarence Thomas, who are all conservative voices on the court. Justice Anthony M. Kennedy, usually a swing vote, also joined the majority. Liberal Justices John Paul Stevens, David H. Souter, Ruth David Ginsburg and Stephen G. Breyer, all voted to restrict Americans' freedoms.

Those crazy French vintners. This is what socialism and an overreliance on government aid does to people. They don't know how to live when faced with obstacles:
Winemaker protests in France
MONTPELLIER, France (AP) -- Winemakers in southern France have burned two police cars and vandalized supermarkets during protests to demand government aid.
Vintners in France's Languedoc-Roussillon region have been protesting plummeting prices for their regional wines as well as rising fuel costs.
Top regional official Cyrille Schott says protesters broke windows at the courthouse in the city of Montpellier. In nearby Montagnac, protesters wielding baseball bats chased police from their vehicles and set the cars on fire.
Schott says protesters damaged four bank buildings.
At three regional supermarkets they sacked the wine aisles. Schott says two police were slightly injured in the protests Wednesday and early Thursday.

This story is unbelievable. If the father is suing Children Services for failing to protect his daughter, then I might have to sue Gilberto Ugalde for the same thing.
This sickens me.
This is really the result of more than a half-century of America's nanny state where we can't do anything without government approval. We have become a nation of sheep, brainwashed by a government-run education system that tells us we should trust the government to protect us. Trust me, if I had even an inkling that this was happening to a child of mine, I would not be waiting on Children Services to protect that child. That is the role of a parent and other family members, not the state.
I suspect Ugalde is nothing but a money-grubbing fiend who should be in prison along with his estranged wife for allowing this to happen to his children. This man apparently didn't give a damn what was happening to the children until one was killed and he saw an opportunity to make a buck.
I hope I am wrong, but I doubt it.
My two new weblogs
My activity here the last week has been minimal because I was busy creating two new personal weblogs.
Lucente su Vino: This is my personal weblog on all things wine. I am doing this just for fun, so I don't expect my blogging will be excessive, probably no more than once or twice a week. I plan to talk about news in the wine world as well as reviews of wines I drink. This won't be a technical blog on wines, just my impressions in plain language. Jus Sanguinis: This is a chronicle of my quest for dual citizenship with Italy. Under Italian law, I have been a citizen since birth. However, because I was born in the United States, I have to go through the process of having my Italian citizenship registered with the proper authorities. This will also be a low traffic Web site as I will only be updating it as things happen in this long process. The name comes from the philosophy that permits this citizenship and is Latin for "Right of Blood" This weblog will probably have little interest outside myself or other Italian-Americans interested in having their dual citizenship recognized. [COLUMN] Libertarians should oppose Obama
What a topsy-turvy world we live in when libertarians begin to support a socialist for president.
More and more I am seeing libertarians voice support for Sen. Barack Obama. Web sites are springing up and libertarians on Internet forums are arguing for Obama. Having not yet settled on a candidate, I have tried to understand their reasoning. Unfortunately, like socialism and Obama, there is only a pretty façade and no real substance.
I understand their frustration. Libertarians hate President Bush, mostly because of the war and his constitutional abuses.
Libertarians such as myself were opposed to the war from the beginning. It was a stupid endeavor and made no sense politically or militarily.
So, if we are keeping a scorecard, Obama gets one point for opposing the war, even if his opposition to it was tepid at best in 2003.
That is, however, where the lead ends.
I don't want to defend Sen. John McCain. He is the worst kind of Republican, a big-government liberal. However, if we are to compare McCain to Obama, it is clear who is closer to the libertarian viewpoint when it comes to issues beyond the war.

A small quiz for you
In the June edition of ABA Journal there was a small article about how judges make mistakes because, like most humans, they are intuitive rather than cognitive in rendering their decisions. In other words, they tend to go with the obvious, quick answer rather than the correct, logical answer.
To prove this, 295 Florida trial judges were given this three-question quiz developed by professor Shane Frederick of the Massachusetts Institution of Technology. Only 15 percent of the judges got all three answers correct and 31 percent of the judges got all three wrong.
The judges should not feel bad, while that rate was below students at Harvard, it was better than the students at the University of Michigan.
Take the following test and see how you do. If you get all three right, that means you are cognitive. If you get all three wrong, you are intuitive. Post your answers in the comment box. Don't be ashamed. This is not an intelligence test. Lots of very smart people get these wrong. This is about how you think, not how smart you are.

[COLUMN] Golden rule should guide us all
A common criticism I hear from people trying to discredit a libertarian outlook on life is that because I believe the government should not be outlawing a certain thing, I must, then, condone such activity.
For example, because I support the legalization of drugs, I must therefore support drug use.
However, such thinking is either the result of dishonest debate or uncritical thinking. It is akin to calling someone an atheist simply because he or she believes in evolution.
I support the legalization of drugs, not necessarily the use or abuse of drugs. After all, what a person puts into his or her body is of no concern to me or to the state.
I support the legalization of prostitution, not necessarily the act of prostitution. After all, what two consenting adults do with each other is of no concern to me or to the state.
I support the legalization of gambling, not necessarily the act of gambling. After all, how an adult spends his or her money is of no concern to me or to the state.
In other words, the legalization of an activity is a separate argument from the actual activity. I don't understand why that distinction is so hard for some to comprehend.
Living in a free society does not mean living in a society where the majority is permitted to use the force of law to impose its moral or philosophical beliefs on the minority.

Sheriff owes apology for wasteful sting

Over the weekend, the Allen County Sheriff's Office once again engaged in tyrannical practices by wasting money and valuable resources to entrap a few minimum-wage store clerks into breaking an unconscionable law, which, by the way, is only a misdemeanor offense.
Really, don't we have more important things to worry about in this community than a few clerks selling alcohol to adult police officers?

Another simple-minded argument from creationists

A journalist with France 24 in Paris sent me this video (yes that is Kirk Cameron, he became a Christian evangelical at age 17 and is a partner in the evangelical Christian ministry The Way of the Master) and asked me to defend its conclusions. While I appreciate the opportunity to express my opinion to the French people, this video, which is several years old, is beyond defending.
The idea that the banana proves the existence of God simply because its shape makes it easy for humans to hold and eat is preposterous. Such arguments give all Christians, especially evangelicals, a bad name. Using the logic of this video, one could easily argue that the pear, pineapple, or apple, to name a few, disprove the existence of God because they are not as convenient to hold or eat.
Nor does the conclusion reached by Cameron and his buddy, Ray Comfort, take into account the wild banana. The banana we eat today is the result of thousands of years of domestication and cultivation. The wild banana, on the other hand, is not as easy to eat, is full of hard seeds, and is shaped differently. Also, if the banana is so perfect, why is it is so difficult to ship without damage?
This is typical of the simple-minded thought processes of some creationists. They are so convinced that the universe was created in a way imagined by some Jewish priest 6,000 years ago that they will grasp at every straw to try to make things fit their preconceived notions. Imagine what life would be like if doctors relied on 6,000-year-old Jewish texts when performing medical procedures.

This New York Times report is the reason John McCain should never be allowed to occupy the White House.
McCain and his ilk (including President George W. Bush) believe the Constitution can be reinterpreted depending on the situation of the day. That is clearly not the case. The Constitution is not a complicated document. It means what it says. The Sept. 11, 2001, attacks did not in anyway negate the government's requirement to get a warrant before spying on Americans. Period. It is that simple. Anyone who says otherwise is either an idiot or lying.
From the looks of this election, no one is going to win and the American people are going to be the real losers.

Barack Obama wrapped up the nomination Tuesday night and Americans everywhere should rejoice that Hillary Clinton lost. After all, if she can't even manage her campaign, how can anyone expect her to be able to run the country? She is an evil person who cares only about herself. Like her husband, you can't believe a word that comes out of her mouth. And she has no honor and lacks all respect for the rule of law, as evidenced by her attempts to change the rules after the fact.
Ultimately, however, Obama's politics is not much different from Clinton's so hopefully Obama will lose the general election in November. After all, the last thing this country needs is a tax-and-spend socialist like Clinton or Obama.
Sorry for the absence
Sorry for the absence. The new baby had a medical issue and we were not allowed to bring her home until this weekend. She is doing well, now.
Also, during the weekend there was an explosion and fire at the data center where my web server is kept. No one was hurt, but power was lost for about 48 hours making my Web site inaccessible. I am sure the was frustrating for anyone trying to access the blog.
